Terms of Service — PADO Mobile Application

Introduction

The mobile application PADO is owned and operated by 7DESIGN Sp. z o.o., ul. Zygmunta Krasińskiego 15a-3, 50-449 Wrocław, Poland, NIP 8993003314.

The App allows users to book padel courts, register for training sessions and tournaments, and access community and club-related services.

The App enables Users to initiate payments for physical, real-world services via third-party payment providers, including Stripe. The website is for informational purposes only and does not support payments.

Complaints related to the App can be submitted to [email protected] and will be reviewed within 14 calendar days.

These Terms are governed by Polish law.

1. Acceptance of Terms

By downloading, installing, or using the PADO App, the User agrees to be bound by these Terms of Service. If the User does not agree, they must not use the App.

These Terms apply to all users of the App, regardless of whether they access the App via iOS (Apple App Store) or Android (Google Play Store). Apple Inc. and Google LLC are not parties to these Terms and bear no responsibility for the App or its content.

2. Description of Services

The PADO App enables Users to:

  • book padel courts,
  • find and register for coaching sessions,
  • participate in tournaments,
  • interact with clubs and communities.

Payments for participation in tournaments, bookings, and other services are processed via third-party payment providers, including Stripe.

PADO does not provide its own payment processing services and does not store full payment details such as card numbers.

All payments relate exclusively to real-world, physical services (such as sports events, court bookings, and training sessions) provided by third parties. No digital goods or in-app content are sold through external payment providers.

2A. Platform Role

PADO acts as a technology platform connecting Users with independent third-party providers, including clubs, coaches, and tournament organizers. PADO does not guarantee, vet, or endorse any service provider listed on the platform.

Unless explicitly stated otherwise, PADO is not the organizer, provider, or host of the events or services listed in the App.

3. User Account

To use the App, the User must:

  • create an account,
  • provide accurate and up-to-date information,
  • keep login credentials secure,
  • immediately report any unauthorized access or misuse.

3A. Account Suspension and Termination

PADO reserves the right to suspend or terminate a User account in case of violation of these Terms, suspected fraud, abuse, or unlawful activity.

4. Payments and Refunds

Payments for services available in the App are processed by third-party payment providers, including Stripe. By making a payment through the App, Users also agree to Stripe's Terms of Service and Privacy Policy, available at https://stripe.com/legal.

PADO does not store full payment details such as card numbers.

At this stage, PADO does not charge additional platform fees. Payments are made directly for services provided by third parties, such as clubs, coaches, or tournament organizers.

All prices displayed in the App are in the currency shown at the time of booking. Any applicable taxes are the responsibility of the service provider. PADO is not responsible for currency conversion costs or bank charges.

PADO is not responsible for payment processing errors, delays, or failures caused by the payment provider.

PADO is not a party to the transaction between the User and the service provider and does not act as a merchant of record, unless explicitly stated otherwise.

Apple Inc. and Google LLC are not parties to any payment transactions made through the App and bear no responsibility for any charges, refunds, or disputes.

4A. Cancellations and Refund Policy

Refund and cancellation policies are determined by the respective service provider (club, coach, or tournament organizer). Service providers are required to display their cancellation terms clearly before the User completes a payment.

If a User experiences an issue with a payment or service, they should:

  • First, contact the service provider directly using the contact details provided in the App;
  • If the issue is unresolved within 7 calendar days, contact PADO at [email protected];
  • PADO will use reasonable efforts to assist in mediating the dispute with the provider.

Complaints related to the App itself may be submitted to [email protected] and will be reviewed within 14 calendar days.

5. User Conduct

Users agree not to:

  • use the App for unlawful purposes,
  • violate the rights of other users or third parties,
  • interfere with the operation or security of the App.

5A. Liability for Services

PADO is not responsible for the organization, execution, quality, safety, or cancellation of services provided by third parties, including tournaments, trainings, and court bookings.

Event details, including time, location, and availability, may change. PADO is not responsible for such changes or cancellations made by service providers.

Any claims related to such services should be directed to the respective provider in the first instance.

6. Intellectual Property

All rights to the PADO brand, application, software, and design are owned by 7DESIGN Sp. z o.o.

Users may not copy, distribute, or modify any part of the App without prior written consent.

7. Data Protection

Personal data is processed in accordance with the PADO Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (GDPR).

By using the App, Users consent to the collection and processing of their personal data as described in the Privacy Policy.

8. Right of Withdrawal

The right of withdrawal does not apply to services related to leisure activities, including sports events, tournaments, and court bookings, if the contract specifies a specific date or time of performance, in accordance with Article 38(1)(l) of the EU Consumer Rights Directive and applicable Polish law.

9. Governing Law and Jurisdiction

These Terms are governed by Polish law. Users based in other EU member states retain the protection of mandatory consumer protection provisions applicable in their country of residence.

10. Third-Party Platforms

The PADO App is distributed via the Apple App Store and Google Play Store. The following applies with respect to those platforms:

  • Apple Inc. and Google LLC are not parties to these Terms of Service.
  • Apple Inc. and Google LLC have no obligation to provide maintenance or support services for the App.
  • Apple Inc. and Google LLC are not responsible for any product liability claims, consumer protection claims, intellectual property infringement claims, or any other claims related to the App.
  • In the event of any third-party claim that the App infringes intellectual property rights, Apple Inc. and Google LLC are not responsible for the investigation, defense, settlement, or discharge of such claims.
  • Users must comply with applicable third-party terms of service when using the App (e.g., Apple's Usage Rules).

11. Changes to These Terms

PADO reserves the right to update or modify these Terms at any time. Users will be notified of material changes via the App or by email. Continued use of the App following such notification constitutes acceptance of the updated Terms.
